General Prosecutor's Office: Through reconciliation court cases to reduce by 30% till 2017
This has been stated today in Astana in the General Prosecutor's Office of the Republic of Kazakhstan when opening international scientific conference to discuss the concept of "Bіtіmgershіlіk-reconciliation" (in criminal and civil proceedings) by Prosecutor General of Kazakhstan Askhat Dauylbaev.
"A key aspect of the concept is to change the system of dispute resolution in direction of greater use of conciliation procedures and other non-judicial mechanisms, " said A.Dauylbaev.
As believed by him, the benefits of healing measures are obvious, as they represent the use of the right to resolve disputes on the basis of equity, taking into account the interests of both sides. As a result of a settlement agreement saved are time and money as of the court and the parties involved in the process, normal human and partnership relations remain, reputation and respect in the business environment are preserved. The importance of bringing restorative justice character for years has been stressed in the speeches of the President.
"The idea of introducing various forms of mediation in resolving disputes has been transferred into the Concept of Legal Policy of the Republic of Kazakhstan for the period 2010-2020. But this sort of course of the judicial system has not yet properly been realized.
In Kazakhstan only 3% of civil cases finish peacefully, the practice of reconciliation out of court, including the use of mediation has not widely spread. Meanwhile, overseas "the lion's" share of all disputes find resolution out of court, in the U.S. - 97% in the UK - 87%, and in such a small European country like Slovenia - 40%, " said the Attorney General.
As the Attorney General's Office declares, through the development of institutions of reconciliation until 2017 it is planned to reduce the number of criminal and civil cases in courts by at least 30%.
