Model Law On competition to strengthen Kazakhstan's position in Single Economic Space

ASTANA. December 29. KAZINFORM The Model Law "On Competition" signed by the heads of three countries in November this year will strengthen the position of Kazakhstan in the Single Economic Space, member of the Board (minister) in charge of competition and antitrust regulation of Eurasian Economic Commission Nurlan Aldabergenov said in an exclusive interview for Primeminister.kz.

"We now have three laws on competition, and all the three laws of three states are at different levels. As we opened the borders, our first task was the convergence, that is, we must bring together our national competition legislations. At the same time we need to define the rules that we deem necessary in the three jurisdictions. Kazakhstan is important to have those rules that would prevent all forms of violations," he said.

"The first rule for public procurement is antimonopoly control during tenders. Now Kazakhstan Competition Protection Agency does not carry out this work, but in Russia this rule is applied. This is an international practice. That is why it is necessary for Kazakhstan," he continued.

According to Aldabergenov, next year Kazakhstan will open electronic trading of Russia and Belarus, which in turn will participate in electronic trading of Kazakhstan.

"The second rule of law is disqualification. This rule is widely used in the EU, USA. If a company repeatedly violates the antitrust laws, in addition to fines it is simply disqualified for 3 years. In Russia, this rule also exists, if it will not be used in Kazakhstan, Russian and Belarusian enterprises in Kazakhstan may face reregistration," Aldabergenov noted.

According to him, the Model Law includes all the necessary standards that are required in competition law. In other words, their presence will strengthen the position of Kazakhstan in the Single Economic Space, stop all possible violations.
