On Amending Resolution of the Government of the Republic of Kazakhstan as of January 13, 2012 number 45

"On approval of establishing quotas for foreign labor force in the Republic of Kazakhstan, of the Rules and conditions for issuing work permits for employment of foreign workers and for employers to hire foreign workers and to amend Resolution of the Government of the Republic of Kazakhstan as of June 19, 2001 № 836 "

On Measures for Implementation of the Law of the Republic of Kazakhstan as of January 23, 2001 "On Employment "

The Government of the Republic of Kazakhstan has decreed:

1. Introduce changes to the resolution of the Government of the Republic of Kazakhstan from January 13, 2012 number 45 "On approval of the establishment of quotas for foreign labor force in the Republic of Kazakhstan, of the Rules and conditions for issuing work permits to foreign labor for employment and for employers to hire foreign workers and to amend the Resolution of the Government of the Republic of Kazakhstan from June 19, 2001 № 836 "On Measures for the Implementation of the Law of the Republic of Kazakhstan from January 23, 2001" On Employment "(SAPP Republic of Kazakhstan, 2012, № 23, p. 323) as follows:

the Regulations and the conditions for issuing work permits to foreign labor for employment and for employers to hire foreign workers, approved by this decree:

subparagraph 5) of paragraph 3 to be stated as follows: «5) A program to increase the local staff content in frames of planned and executed by the employer under contract in accordance with the production sharing agreement entered into with the competent authority or the Government of the Republic of Kazakhstan package measures agreed by the competent authority and the authorized body for labor, including vocational training, retraining or training of the workers - citizens of the Republic of Kazakhstan, carried out for systematical increase of local teaching content of the employer; "

subparagraph 14) of paragraph 5 to be stated as follows: «14) engaged in teaching activities in accordance with the international treaties of the Republic of Kazakhstan on cooperation in the field of education in organizations of secondary, technical and vocational, secondary and higher education of the Republic of Kazakhstan but not increasing 25 percent and for those implementing international integrated educational training programs – not increasing 50 percent of the local staff of organization;" in paragraph 8:

the second part to be stated as follows:

"Information on local staff content within employer staff is to be submitted to an authorized body in form of Annex 5 of the Regulation.";

the third part to be added by subparagraph 4) as follows:

"4) The representative offices of foreign legal entities.";

subparagraph 2) of paragraph 18 to be stated as follows:

"2) the number of employers:

implementing programs to increase local staff content having a commitment to hire, train citizens of the Republic of Kazakhstan and the reduction of foreign personnel;

involved in the implementation of projects are included in the list of the Industrialization Map of Kazakhstan for 2010-2014 involving contractors working on start-up, commissioning and installation of process equipment;

involved in the implementation of "Performance 2020" program, received a positive decision on the provision of government support in attracting highly qualified foreign specialists;

attracting foreign labor within the quota for priority projects and countries of origin;

attracting foreign labor representative offices of foreign legal entities;

are government agencies or state-owned enterprises of the Republic of Kazakhstan. ";

subparagraph 3) of paragraph 36 to be stated as follows:

"3) information on local staff content;"

Annex 5 of the Regulation to be stated in accordance with the Annex to the Resolution as follows;

paragraph 6 of Annex 7 of the Regulation to be stated as follows:

"6. Information on local staff content.";

paragraph 5 of Annex 9 to the Regulation to be stated as follows:

"5. Information on local staff content. ".

2. The Resolution shall become effective upon the expiration of ten days after the first publication.
